Buddy,
If a majority of members on IV are not in support of your idea, would you agree that its not fair to organize these kind of things on IV forum? I can imagine how hard it was for the people to bring this organization to this stage. While you haven't contributed much, you are trying to break it up for your own selfish reasons. God knows if you will really benefit anything out of this. How different are you from anti-immigrants who claim that immigrants are stealing American jobs?
Can you change the poll to include EB2 people who do not intend to support you idea? You say a number of people are supporting you...and 6 is a number? What is the percentage?
I have not raised anything yet. We do have a number of members ready to support. We are getting there. People, please come forward. Lets get this thing going.
Send me a PM if you are not sure about posting on the forums here.

Well explained.
Most of EB2 falls into : 1.Advanced Degree-(where most of us fall into ) it is either masters or Bachelors+5 years
Till now there is no proposal to change the above.
The internal memo is for Extraordinary Ability quota, and it is in comment period. It is not implemented yet.
The similar kind of restriction should be applied for EB1 - multinational executive quota.
Thats why I asked earlier whether this memo has anything radically different then what already exists? Nope.

Yes..a fairly correct and concise way of putting it !:)
So now guys realize how RD becomes crucial within the PD current window !
If the window is too current say 06/07 than it may not be fair to older PD's
if it around 2003 the window is not too wide and quotient of fairness increases.
He is absolutely correct. 485 Processing would start depending on RD (Receipt Date). But at the time of approval PD should be current and if it is current then the applicant whose RD (Receipt Date) is oldest would get the approval first.

Doesn't help us any. The spillover numbers will go to the country which is most retrogressed. So, if Mexico EB3 goes back to April 2001 and stays there and there are any spillover numbers they will first go to Mexico.

That is exactly what I thought as well. Which is why I'm confused by posters ranting about "people who voted against SKIL bill" and getting their knickers in a twist
Correct me if I am wrong, ---but I thought that "This Ammendment" was attached to a defence bill. I dont think that it was the ammendment that was shot down, but the whole defence bill.
Kindly note,
This particular Cornyn amendment (S.Amdt. 2339) offered to attach to H.R. 2669 (College Cost Reduction Act of 2007 ), but the motion was failed due to lack of 5 votes.(55 YEAS and 40 NAYs. Require 3/5 majority) HR.2669 is passed by both Senate and house and sent for conference to resolve the difference between house and senate versions and president is sure to sign the bill and thus would become the law in another few days. This amendment does not have anything to do with defence bill or with SKILL bill. Following is the actions taken by congress of HR 2669.
IF THE AMENDMENT HAD PASSED WE WOULD HAVE GOT ATLEAST 240,000 RECAPTURED, UNUSED VISAS OF PREVIOUS YEARS IN ANOTHER FEW DAYS.
H.R.2669
Title: To provide for reconciliation pursuant to section 601 of the concurrent resolution on the budget for fiscal year 2008.

Well, one or two of us are dispensible but if unite in our effort, then we definitely become indespensible....did we really make an impact by making those thousands of phone calls for the lame duck?.....the fact is that an average american doesn't give a ***** about whether we get our green cards or not because they don't even know our pains.....and the government has too many other trivial and not so trivial issues to deal with than worry about us......lobbying is a good idea but we are still not getting the attention we should be getting......do you think they can really abolish the h1b program?.......foreign workers have become the veins and arteries of these companies and unless until you stop the blood supply, no body is going to even notice.......the dependency on foreign workers is more today that it was a decade ago just because of the sheer volume.
no the h-1b program will never be abolished. foreign workers are needed in univs for one. and don't forget that the chinese came here to build the rail-way(road) and the indians and chinese (and ppl from many other nationalities) to fix the y2k bug. but regarding making phone calls, i think your assesment is wrong. that made the biggest impact of all. and guess what it costs? almost nothing other than some time and cell phone minutes. let's call Senator Cornyn (see another thread started by jansilal).

He has already been able to pass the law. Now whether he calls them chopshop or backtracks, or praises them.......it does not do anything. This will soon be a law.
Yes, the law doesn't change. But its less hurtful.
It would be equivalent of Indian minister calling Pepsi/Coke as poison sellers. (BTW, which they are)

I agree with you. It is important to know if the US data excluded international students or not. You can find the papers here:
http://www.soc.duke.edu/GlobalEngineering/papers.html
The relevant one seems to be the following:
http://papers.ssrn.com/sol3/papers.cfm?abstract_id=991327#PaperDownload
This one is probably more relevant:
http://papers.ssrn.com/sol3/papers.cfm?abstract_id=1015843#PaperDownload
Basically go through all the papers to get the complete picture of his position.

Looking at , it seems that latest approvals really come from ROW and Philippines for EB2 and EB3.
So ROW and Philippines filers, hang-on!

Also, current Economy may force them to use larger number of FB visas for EBs for next few years.
.................................................. .....
Could you explain this point. Why would lesser number of FB visas be issued in a bad economy ?
Does economy state has any relation to FB visas ?
For pre-adjudication, visa availability or the chances of PD becoming current is not necessary. They can pre-adjudicate based on receipt date.
My guess:
Probably they are processing all employment based applications right away so that they can prepare for CIR 2009. I guess Obama will take CIR this year itself as he has a very high approval rating and lot of goodwill now.

Once they accept I-485 in the system then they give us a Receipt#, with that Receipt we can file for EAD / AP (as long as your PD becomes available) then they will process your I-485, Just thinking.. what do you say guys ... Please lete me know.. Receipt Date Vs Visa Number ...
Thanks

This loss of visas is due to:
gaps in USCIS accounting of cases;
USCIS not processing enough pending applications in a timely manner; and
the imprecise art of predicting workflows and demand surges at three federal agencies:
Department of Labor (DOL) (approves labor certifications);
USCIS (processes immigration petitions after completion of labor certifications and processes green card applications for applicants in the United States); and
DOS (establishes priority dates and processes immigrant visas from applicants outside the United States).
Macaca, thanks for the analysis.
My question is, is IV paying enough attention to this?
What I have seen is that IV is spending 80% of its energy to change the current immigration law (increase the EB visa numbers in some fashion etc.). As far as I can see, this is not going any where due to a variety of reasons.
Is it time to rethink our priorities? If we put more of our collective energy to force USCIS to do a better job, will we get better results? Sure, the immigration law needs fixing. But our predicament is not due to immigration law. Our predicament is that the USCIS is not doing a good job. They are only working 4 hours a day. (I saw a post from a person who went and looked around the USCIS parking lot on a Friday :D. He/She says the parking lot was empty in the afternoon.).
I suggest that the IV core spend 80% of energy in fixing the USCIS bottleneck. We should have another rally infront of the USCIS doorsteps (or a flower campaign or a card campaign or a degree copy sending campaign). 20% of the energy can still be spent on fixing immigration law.
