Hello Gurus,
I have filed my PERM through my employer and they mis-spelled my name wrongly. How can I correct this. Still my labor is in pending condition. My employer says we will change it once got approved. But is there a way to correct it before it gets approved?. Please advice me.

Hi Forum,
My wife has an H1B visa which has been invalidated now because she had to travel to US with me on H4. Her petition seem to be valid. The I94 in her passport has H4 mentioned on it. Now we want to convert her visa back to H1. Since she has H1, I am wondering the H4 to H1 conversion process should be easier compare to applying fresh H1.
It would be great if you guys let me know what is the process of converting this without going back to home country.
I appreciate your help

All,
I'm a EB2 filer and PD is 2003. We did a concurrent filing on Jul 2nd, received receipt notices for the same, FP Completed and EAD approved.
I see the A NUMBER printed on my 140 and 485 receipt notices. I wanted to understand whether the 'A' number mentioned on the receipt notices is the VISA number or, the VISA number is something different that gets assigned during the adjudication of I485 based on the availability.
Trying to assess the impact of EB2 retrogression on cases that are already filed and Finger printing is complete.
Please Advise.

I am planning to go to India for 3 months. I have EAD and AP, H1B visa stamping valid till 08/30/2010. Now I am on EAD.
From past 3 months, I don’t have project, so I am thinking to go India and come back in the month of Jan 2010 (if US market improves).
My wife is working on EAD and she will be staying in US.
What are the problems I may face at POE, US? (Possible Chicago POE)
Please let me know, what r all docs required and what r all questions will be asked, if I enter on AP or on valid H1B visa stamp.

Is it possible to upgrade a pending I-485 (EB3 I-140) with a newly approved EB2 I-140?
Is there any USCIS mandated procedure to do that?
I think it will be taken care automatically, ( since your A number on I 485 and new I 140 will be the same )

Did any body renew thier EAD's recently?..instruction on page 12 says that the Filing fee of $340 is waived coe category C9...is that true..:confused:
Only for people who paid the new I-485 fee effective July 31st, 2007. Lot of the July 2007 VB filers (even in August 2007) paid the old fee, and have to pay the $340.

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. As long as you have a valid advance parole, an approved I-140 and a bona fide offer of employment in the same or similar occupation you are not likely to be at risk if you go to India. However, before making a decision to travel, you should consult with an immigration attorney fully familiar with your immigration and employment history.

I was in confusing situation,hope you can clarify and help me out.
My wife came to US as H4 in Feb 08.Her i-94 is valid till march 2010.
She applied H1 got H1 approved from Oct08 for 3 years.Since from Oct08 , employer couldnot find project for her.Her employer is asking to move from H1 to H4 back using Cos(i-539).After getting project can move back from H4 to H1 which doesnot come under quota.
My questions are:
1.Is it safe to move from H1 to H4 and back to H1 when she gets project.
2.Her previous H4 i-94 is valid till March 2010.She didnot went to india again.
If she converts from H1 to H4 now,till when she will get i-94(till my H1 valid or original i-94 date).
If she gets i-94 till original i-94 i.e March 2010,does she needs to go to stamping after March 2010 again or continue to be in US even after March or just go for border and get new i-94.
Can you please clarify.
Any suggesstions is really apprecaited.

There is no special form to apply for AC21. It's a free form letter informing the USCIS that you would like to port your I-140 to a different employer.
