I am currently a H1B visa holder engaged to a US citizen. We are planning on going to India soon for the formal engagement ceremony and getting married early next year.
I had two points of concern:
1. Upon returning after the engagement, I will still be on H1B (since the wedding is going to be a bit more than 90 days after the official engagement so the K1 visa is not an option), will this cause issues at port of entry?
2. After marriage, we plan to go abroad for our honeymoon (we likely won't have time to file anything with immigration before our return): how should I proceed upon reentry then or is this even advisable since I'll be returning on an H1 but be married to a US citizen?
Any advice would be greatly appreciated, thanks.

I am a July 2007 filer. I filed for I-485 using the old fee structure and also applied for AP in July 2007. My AP got approved in 07 but expired so I had to apply for AP in Aug 2008. So I filed in Aug 2008 and paid $305 for AP fee. Now it's to reapply for AP as it expires soon; however I was under the impression that I wouldn't have to pay for AP fee again. I sent the forms to USCIS but the AP package got returned as they claim i don't qualify for free fling.
Anyone else in this position (I am assuming a lot of you guys are... please share your experience). Do we have to pay every year for AP?

I was on H4 and had applied for H1B in 2008. After long processing and being pending for a long time it finally got approved in July 2009.
My question is, does my H1B start from oct 2008 or oct 2009? Can someone reply me on this.

Hi. I am a Canadian Citizen that was offered a Management job in US.
I would appreciate any advice in regards the best way to ensure a LONG stay in US. The company wants to start with a TN.
Strategy #1:
To stay under TN and keep it renew it for a long term �. 10-20 years. The risk is that the guys at the border will say no at some point; however I wonder if I can request an appeal since there is no limit per TN rules.
( are there any cases that have stayed that long?)
Strategy #2:
Start with a TN then file an H1b and wait for the Labor of certification to be approved. If I do not hear anything in 1 or 2 years; change to TN to revise the strategy�. in order to avoid consuming the H1b 6 years lead time allowed and try again later.

I am on h1-b since Oct 1, 2004. I am EB3-ROW (Rest of World). My company has filed I-140 in June 2006 and it has not been approved yet. How soon would I be able to change jobs? I'm about to finish my master's degree and am hoping to get a job that falls in either eb-2 or eb3 category. How will this impact the ability to keep my i-140. Would i have to start from scratch with my new employer if i find a new job?
Also what is considered my priority date since I havent/cant file an i-485 yet.

I filed I-131 for AP renewal around 10th August and received a Biometrics appointment notice for I-485 yesterday. Is there Fingerprinting required for AP? If yes, why is the Case Type on the notice I-485? Or is the FP notice for I-485 and it is just a coincidence that I have filed for AP renewal. My PD will be current next month...

One of the threads I read about requirements for I-140 smooth approval.
Please let me know
1.if anybody got any RFE's recently for getting I-140 cleared or processed. If so, what are they asking.
2. How important are salary slips in getting this approved
3. Are they asking for any recently pay stubs, if so, for how much period back in history.
The reason I'm asking this is sometimes we loose pay stubs, and hence I wanted to make sure I have all, in case any is missing.
4. Any risks in getting I-140 premium processed when dates are not close to current.
5. Any other risks.
6. How much time is it taking for regular I140 to get processed.
Any advice to this end is highly appreciated.

My 6years of H1 expires on Apr'2011. Company A filed for perm, perm went to Audit, Got 7th year extension which expires Apr'2012
Later, moved to Company B, got Change of Employer approved until Apr'2012.
Now I am going to India and need to get stamping. Will I have any issues in getting the visa stamping for 7th year? Please advice.
Both Company A and B are very big companies and I am direct employee not a contractor.
I have the CompanyA's perm screenshot and email, but don't know what its status, as i left the company and I am not in touch with them
