GC/485 is for a future job.So if your former employer is willing to not revoke your 140 and answer ability to pay issues if required,then i guess you can file 485 with your old employer.

The worrying news below talk about findings that the U.S. has lost influence abroad as a result of the Iraq war, thus encouraging detractors such as Russia and Iran...so, this begs the question: Is this really the time for the country to also encourage loss of influence at home, by promoting a massive and catastrophic Reverse Brain Drain? Hi I'm a Moroccan citizen I was placed in removal proceedings (NY Buffalo) and took voluntary departure. once my wife's divorce was finalized we got married while on voluntary departure. we filed motion to reopen the case and it was reopened and transferred to Los Angeles, CA then the judge closed my case based on marriage with an I130 receipt without prejudice. The I130 was filed on june 2009 and was transferred to Los Angeles on November 12, 2009. I made an appointment with Info Pass but they just said you have to wait untill we call you. My lawyer said I can't file for the I485 untill the I130 is approved. My question is: How long will it take before we will be called for an interview?

Hi all,
This is urgent, your response is appreciated. I am switching jobs and my new employer wants me to go to the UK for some training in a week for about 5 days. They are sending the H1-B transfer application in couple of days, so the transfer has not been done. The img. lawer said they will send the receipt notice to me in the UK and I could travel back with my previous H1-B visa from my previous employer. I am a citizen of India woking in the STEM field for the last 2 years. I am still working and my employment will last for about 1 more week.
QUESTIONS:
1. Please let me know you see any problems at immigration when coming back to the US?
2. Can the employer wait couple of more weeks before sending cancellation of my H1-B visa without paying me during that time?
3. If I take an unpaid leave durimg this time, will that help?

after nearly 3 yrs.
Another friend of mine (same company) was in the same boat, but his processing was like 3 months ahead of mine(for all these steps). His Appeal was sent to BALCA and he is waiting for their response.

1) In DS156 should my answer to the Question� �Has Anyone Ever Files an Immigrant Petition on your behalf� be NO. FYI, my 140 is approved and waiting on 485 priority date. I don�t think I gave my wife�s name yet in my labor or 140 approval process
2) There is a section to be filled in VFS website called� Petition Details from 797/. I assume that principal applicant would be me. However I am not sure what to fill in the following questions

Petition Expiration date
Petitioner Name: I assume it is my company name
Is the above info to be filled in from My 797 ( case type I129)or my wife�s 797( case type I539) Receipt #?

Does BEC Capture the following information at the time of entering data..
Type of application � Eb2, 3 or Other workers category..
Nationality of application..
My understanding is that BEC does not determine the EB2 or EB3 until the final stage, nor is the nationality captured as part of the older labor process (I could be wrong.).. and if the nationality is captured then an application of an Indian can only be substituted by an Indian???
In case they don�t,,, how can DOS determine the all the 245(i) applications at the BEC are Eb2.. or Eb3.. or for that matter from India. On an optimistic side.. when all the cases at the BEC get cleared in June 07 and DOS realizes that bulk of the cases were for Other Workers Category .. may dates for EB2 and EB3 could make huge movement forward then..

My Title is different in H1-B and GC, though it is in the same field.. I am going for stamping to Chennai in January.. Will this be a problem ? Will they ask questions about I-485 filing in H1-B stamping ?

There are instructions on your original letter from the IRS telling you that your application for an ITIN number was granted. I believe you need a copy of that letter and a copy of your ssn to send back to them. If you cant find instructions send me a private message and I will pull my letter out for you.
