Do you mean 1099 by anychance?
Do you mean an I9 form -
that is required to be maintained by the employer for all employees (even US Citizens)
Yes on EAD you can/have to fill that

Hello everyone,
This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -
1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?
2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.
3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?
Thanks in Advance...

The week's news dealt a body-blow to the prospects for comprehensive immigration reform, as if the movement to fix our broken immigration laws were blind-sided in a collision with a former pinup driving a pickup -- which it was. With the election of new Massachusetts Senator, Scott Brown, to take the seat of the late Ted Kennedy, the godfather of more humane and just immigration laws, supporters of CIR (Comprehensive Immigration Reform) are swallowing their sadness and putting on their game faces, saying there's still no stopping the CIR train from arriving at its destination. It's hard to maintain optimism,...

The July Visa Bulletin is out and there is really no good news. And there's terrible news for Mexicans and Chinese applicants. The Mexican 1st and 3rd family categories move backwards nearly two years. And Chinese EB-2 employment immigration applicants now join the Indian misery as priority dates retrogress five years (!) to January 2000. Here are the numbers: Family 1st - Advancement of worldwide, China and India numbers by one week to 15 NOV 2002. Mexico retrogresses nearly two years to 1 JAN 1991. The Philippines is stalled at 1 SEP 1993. Family 2A - Worldwide, India, China and...

We went to india this last december and used AP, no issues what so ever.

On July 20, 2010, the House of Representatives passed, by voice vote, the International Adoption Harmonization Act of 2010, to amend the Immigration and Nationality Act with respect to adopted alien children.
The International Adoption (http://www.h1b.biz/lawyer-attorney-1131866.html) Harmonization Act of 2010, HR 5532, will allow an adopted child to legally immigrate so long as the adoption is completed and the petition is filed before the child turns 18. The current age limit is 16. The bill would also restore an international adoption exemption that was inadvertently eliminated when the U.S. joined the Hague Convention on Intercountry Adoptions.
The bill was sponsored by Immigration Subcommittee Chairwoman, Zoe Lofgren (D-CA).

Hi
I just got my labor cleared. EB3.
I need to get the I140 processed
Any idea how much time it generally takes for this to process.
The reason I'm asking is because my h1 needs to be processed in April and if this I140 gets cleared before that, I can get my h1 extension for 3 years.
Thanks
Vivek

I have exact opposite case. My 140 was approved at TSC. Lawyers sent 485 to NSC. I asked they said its ok. Since they sent copy of 140 with 485. You can file anywhere.

My father in law mistakenly entered the wrong date for his date of arrival in the U.S. (entered data in Indian style) on his citizenship application form. The number of days out of the country was also wrong.
Is there a way to rectify this mistake and inform USCIS about this ? Is there a form, or can we simply write a letter regarding the errors to the USCIS office ?
What would be the best way to address this issue ?
Thanks

Congratulations IV!! We have reached the 4000 member mark. While this is definetly a milestone, like TO_BE_OR_NOT_TO_BE and ragz4u pointed out, we have a lot more potential...
Now that being said, there is a difference between 'giving' vs 'taking'.. In the last couple of weeks we have had 100's of people register to become members, and yet whenever IV volunteers ask for contribution, less that 1% of the new people come to contribute.. That is a TAKER mentality..
Logiclife had started a thread (http://immigrationvoice.org/forum/showthread.php?t=895)that clearly explains why you should contribute.. we have about 2800 members that are yet to contribute... Folks, While a contribution of a 100$ is not a big deal, even if we contribute 50$ (to start with) and 50% of the 2800 people contribute we would have an additional $70,000. This should not be a big deal..
Please visit logiclife's wonderful thread and reply after contributing and helping yourself by helping IV!

Dear All,
Can someone tell me how long it takes to get 485 filing receipt? Who gets it ,you or the lawyer? What information should a responsible lawyer pass to you after 485 is filed?
Please let me know. It would be good information for everyone.
The thread "June 1st filers" has the responses to your question.

My I-485 is pending with PD of Oct 11 2006(EB2 India). I have been on H1 as was not able to add my spouse to my initial 485 application. As my H1 expires on Sep 6, we recently filed for H1/4 extension and received an RFE for Employee-Employer relationship. We have to answer this by Sep 13. As a Plan B, What we did in June 2010 was
a) I filed for my EAD
b) My spouse got admitted into a school here and applied for COS from H4 to F1 with a valid I-20.
Both of these cases are currently pending.. My questions are:
1) As our H1/4 and I-94 expires on Sep 6, Would we still be in legal status after Sep 6 as both of our cases (EAD and COS) are pending?
2) After answering the RFE, if it is denied, would it impact my GC processing?
3) I understand that even if my H1 is denied, As I have a pending EAD, my status would be okay but what options would we have if my Wife's case is denied.
Thanks in Advance!

As many of our clients have experienced first-hand, unannounced H-1B site visits are well under way through USCIS' Office of Fraud Detection and National Security ("FDNS"). Such site visits may occur at the H-1B employer's principal place of business and/or at the H-1B nonimmigrant's work location, as indicated on the filed Form I-129 petition (regardless of whether the work location is controlled by the H-1B employer). While one may question the legitimacy of such an intrusion on the workplace without warning, FDNS has indicated that it does not require a subpoena to conduct such an unannounced site visit. This assertion...

I read in one of the threads (couldn't locate it now) where USCIS asked for the financials from the new employer in an AC21 case. So just be prepared.

I'm currently moving back to Northern Idaho and am trying to finally get my foot in the door as a photographer. Basically I've emailed some companies asking about the need for a part/full time photographer. Of course, they are all interested in sample shots (not a problem) and rates . I don't know what to say on the rates part. I've searched through the old threads, but didn't see any. Roughly, what is a normal rate? Keep in mind It's not a huge city (pop. 32,000,not including surrounding areas).
Thanks,
Bobby D.
